Competition Terms and Conditions Mezz Bar Package Giveaway
1 General
1.1 The Distillery Road Market Mezz Bar Package Giveaway (Competition) is run by Tonken OC Pty Ltd as trustee for the Tonken OC Trust trading as Distillery Road Market, registered address c/- 124 Distillery Road Eagleby Qld 4207 (Promoter).
1.2 Information on entry into and prizes in the Competition are included in these terms and conditions (Terms). Entries not completed in accordance with these Terms are ineligible. Your participation in the Competition constitutes acceptance of these terms.
1.3 The Competition has one (1) relevant promotional period (Promotional Period) commencing on 29th June 2024 and ending at 9:30pm on 30th June 2024.
1.4 The winner will be drawn on Thursday 4th July 2024
2 Competition Entry and Eligibility
2.1 The Competition is only open to residents in the State of Queensland who are over the age of 18 years (Entrants).
2.2 To enter the Competition, Entrants must attend Distillery Road Market and complete the online form via QR Code with their details and confirmation they would like to subscribe to the Distillery Road Market mailing list operated by the Promoter (Eligible Subscription) during the Promotional Period (Eligible Entrant).
2.3 Employees of the Promoter, the Immediate Families of the Promoter, any person involved in conducting the competition, and any person involved in the management of the Promoter is prohibited from entering the competition. For the purposes of this clause
“Immediate families” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
2.4 Each Eligible entry completion constitutes one (1) entry into the Competition for the Promotional Period.
2.5 Customers can enter once per email address subscription between 29th June 2024 and ending at 9:30pm on 30th June 2024.
2.6 All entries become the property of the Promoter. No responsibility is accepted for late, lost, or misdirected entries or for any delays or failures in any telecommunications service or equipment and the Promoter reserves the right to deem incomplete, indecipherable, or illegible entries invalid. Entries are deemed to be received at the time of receipt into the promotion database utilised by the Promoter and not at the time of transmission by the Eligible Entrant.
2.7 If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
3 Promotion Prizes
3.1 There will be one winner of the Competition.
3.2 The winner will be chosen at random from all eligible entries received. The Promoter’s
decision is final, and no correspondence will be entered into.
3.3 The winner will receive one (1) Distillery Road Market Mezz Bar Package, to the value of AUD$1,000.00. The winner will have a period of six (6) months from the date of notification (via email) to book and redeem the Prize. A maximum of ten (10) individuals, including the winner, will be permitted to participate in this package.
3.4 The total Prize pool in this Competition is AUD$1,000.00 with the retail value of this Prize, as at the date of these terms, being AUD$1,000.00.
3.5 If a Prize or any component of a Prize is not available for any reason (including at the time of any redraw), the Promoter in its discretion reserves the right to substitute a Prize or any component of a Prize with a prize to the equal value and/or specification of the Prize in question, subject to any written directions from various lottery departments.
3.6 None of the Prizes are transferrable, exchangeable, or redeemable for cash.
3.7 As a condition of accepting the Prize, the winner must sign any legal documentation as and, in the form, required by the Promoter, in their absolute discretion, including but not limited to a statutory declaration confirming their compliance with these Terms and eligibility to accept the Prize and/or legal release and indemnity form.
3.8 Each Prize may be subject to further terms and conditions from third parties which are beyond the control of the Promoter and the winners of each Prize must accept those further terms and conditions (if applicable) as a condition of accepting the Prize.
4 Promotion Draw
4.1 The winner for the Competition will be drawn on 4th July 2024.
4.2 In the event a Prize is unclaimed for any reason, a redraw will be held three (3) months after the Promotion Draw for the relevant Promotional Period at 10:00 am at Promoter’s Head Office.
5 Redemption of Prizes
5.1 The winner for the Promotional Period will be notified by email within 2 business days of the Promotion Draw.
5.2 The details of the Prize winner may be published in or on any traditional publication or digital media platform as required for the Promotor to comply with various legislation governing this Competition. By entering, you consent to the publication of your personal details for this purpose.
6 Privacy
6.1 The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at info@drm.market. The Promoter’s privacy policy is available on the Promoter’s website info@drm.market The Promoter will not be responsible or liable for the privacy practices of its contracted third parties. A request to access, update or correct any information should be directed to the Promoter at their email address set out above.
6.2 Eligible Entrants consent to the Promoter using the Eligible Entrant’s name, likeness, image and/or voice in the event they are a winner in this Promotion (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
6.3 The information Eligible Entrants provide will be used by the Promoter for the purpose of conducting this Competition, future promotion(s) and for periodically providing Eligible Entrants with marketing information of the Promoters products and services, whether by the Promoter and/or its contracted third parties.
6.4 The Promoter may disclose Eligible Entrants' personal information to its contracted third parties and agents to assist in conducting this Competition, future promotion(s), providing marketing information about the products and services of the Promoter and/or communicating with Eligible Entrants and to State and Territory lottery departments and winners' names may be published as required under any relevant legislation.
6.5 As personal information will be submitted and held directly by the Promoter, Eligible Entrants should direct any request to access, update or correct the personal information held by the Promoter by contacting the Promoter at info@drm.market The Promoter will not be responsible or liable for the privacy practices of its contracted third parties.
7 Promoter’s Liability
7.1 The Promoter is not liable for any lost or damaged Prizes once they are in the possession of the entity responsible for shipping, chosen in the sole and absolute discretion of the Promoter.
7.2 The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
7.3 If the Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to:
(a) disqualify any entrant; or
(b) modify, suspend, terminate, or cancel the Competition, as appropriate.
7.4 The Promoter will not be liable for any loss or damage or for any personal injury sustained as a result of taking the Prize(s). The Promoter makes no representations or warranties as to the quality, suitability or merchantability or any goods or services offered as Prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the winner and, where applicable, to any persons accompanying the winner.
7.5 Nothing in these conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its officers, employees, and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special, or consequential, arising in any way out of this promotion.
7.6 To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (Relevant Parties) exclude all liability for any loss (including any damage, claim, injury, cost, or expense) whatsoever, which is suffered or incurred by any Eligible Entrant arising out of or otherwise in connection with this promotion or the prizes awarded in this promotion, including:
(a) any indirect, economic, or consequential loss;
(b) any loss arising from or contributed to by the negligence of a Relevant Party;
(c) any liability for personal injury or death; and
(d) use of a prize awarded under this promotion.
8 Dispute Resolution
8.1 If a dispute arises between an entrant and the Promoter, both parties agree to deal with the dispute as follows:
(a) the party claiming a dispute exists will give the other party notice in writing setting out the dispute;
(b) the parties will then try to resolve the dispute by negotiation, within 20 business days from when the notice is given;
(c) if the dispute is not resolved within 20 business days, from when the notice is given, a party may submit the dispute to a form of alternative dispute resolution (including mediation).n).
